Know the Law and Your Local Rules
The first step in protecting your hemp business is understanding the laws that apply to you. That includes federal and state law, but also local ordinances and county rules.
Look up your city and county websites. Check the business licensing sections, local press releases, and regulations. If you need help interpreting them, now is the time to speak with local legal counsel.
Keep Detailed Documentation
Documentation is your best defense during a hemp business raid. Maintain all of the following:
- A copy of your business license (if required)
- Licenses for any vendors or suppliers
- Certificates of analysis for every product containing cannabinoids
- Standard operating procedures (SOPs) for inventory, labeling, and packaging
Make sure your staff is trained and knows how to access these materials—even when you aren’t around.
Train Your Team on What to Do
If law enforcement arrives, it’s critical that everyone on your team stays calm. Here are basic steps to follow:
- Do not argue or interfere
- Ask to see a warrant
- Request to call the business owner or manager
- Comply with all instructions, even if they feel unfair
Never escalate. What happens during those moments can determine the outcome of the situation—and whether you’re facing further legal action.
After the Raid: Next Steps
Once law enforcement leaves, contact your attorney right away. Preserve security footage, make backup copies of all documents, and document exactly what happened.
Hemp laws change rapidly, and unfortunately, the line between legality and criminal liability is razor-thin. A delta-9 THC concentration over 0.3% is all it takes to turn legal hemp into illegal marijuana—often without any visual cues.
